Ryan McInally, 30, was put on the Sex Offenders Register.

Ryan McInally, 30, was put on the Sex Offenders Register in September last year after having sex with a 16-year-old girl at his home while his fiancee worked the nightshift.

The modern studies teacher at Earlston High School in the Scottish Borders was caught when rumours started circulating and staff contacted police.

A hearing of the General Teaching Council for Scotland (GTCS) is due to be held in Edinburgh on Monday where McInally, 30, is expected to be removed from the teaching register with his consent.

In a heavily-redacted statement by the GTCS, the regulator stated: “On 28 September 2015, at Selkirk Sheriff Court, you were convicted of the following offence on Indictment.

“On various occasions between 22 December 2013 and 16 January 2014, both dates inclusive you…did engage in sexual activity with or directed towards [the pupil], a person who was under 18 years.

The teacher had sex with a 16-year-old girl at his home while his fiancee worked the nightshift.

“You did repeatedly kiss her in the mouth…and repeatedly have sexual intercourse with her.

“Contrary to Section 42 of the Sexual Offences (Scotland) Act 2009 In respect of the above offence, you were on 9 November 2015 sentenced to a Community Payback Order of three years which includes 200 hours of unpaid work for the community and three year supervision and your name was placed on the Sex Offender’s Register for a period of three years.”

It was reported at the time of the case, that the sexual relationship between Mr McInally and the youngster started after he gave her a Christmas card with his personal email address written inside.

He claimed this was to help her with her studies and sent her two quotations from one of her favourite books, The Great Gatsby – one of which had “connotations.”

The girl was said to have contacted McInally by email and he arranged for a meeting in the countryside during which they kissed.

He then continued to meet up with the teenager during the Christmas holidays and on New Year’s Eve she stayed overnight at his home.

Defence lawyer Robert More was reported as telling the court that McInally was suspended from the school where he worked when an inquiry was launched into the allegations and he had since returned to the Dundee area with his fiancee.
